Terms and Conditions of Sale

The present
terms and conditions of sale govern the contractual relations between Germaine & Co., the publisher of the website www.kaloes.com, hereinafter referred to as "the Seller,"
on the one hand, and any person wishing to purchase an item on the website www.kaloes.com, hereinafter referred to as "the Buyer," on the other hand.

The present
terms and conditions of sale’s purpose is  to define the terms and conditions of sale of the products offered on the website kaloes.com, as well as the rights and obligations of both parties  within the
framework of the sale of these products.

The site
kaloes.com offers  bags of various styles,
sizes, and colors for purchase. The specifications of each
product are listed on the corresponding product sheet.

Prices are
marked in Euros and include all taxes (TTC) including the VAT in France
(mainland and its overseas departments) as applicable at the time the order is placed.

In addition, the price is identical for international purchases. Because the VAT applicable in France is not applicable in countries outside of the French territory, the prices that are marked do not include taxes and will not be the object of a tax refund.

Therefore, the price including the VAT in France excludes the VAT outside of France.  

The seller reserves the right to change prices at any time; however, products will be invoiced based on the price that is applicable when the order is validated.

The ordering process is as follows :

• Browsing the website : The User browses the website to find the products they are interested in.
• Product Selection : The User selects the desired products by clicking on the “Add to basket” button.
• Access to basket : The User accesses the basket by clicking on the matching icon and can check which products as well as how many
  products were selected.
• Logging in to an account or creating an account : The user connects to their existing account or creates a new account
  to proceed with their order. They can also place their order without creating an account.
• Shipping Information : The user enters the shipping information such as the shipping address and the desired shipping method.
• Payment : The user selects the desired payment method
  and enters the payment information, such as their credit card or PayPal account information.
• Order Confirmation : The user can check their
  order information and payment details before confirming their order by clicking on the button “Order Now.”
• Order Confirmation : After the order has been placed, the user receives an email confirming the order, with a recap of the products that were ordered, the shipping and payment information, as well as the order number.
• Order Handling : The e-commerce website team
  processes the order and prepares the products for shipping.
• Shipping and Delivery : The products are shipped
  to the shipping address provided by the user, who receives a shipping confirmation email with a tracking number allowing tracking of the package.

Accepted payment methods are credit/debit cards (Visa, MasterCard,
American Express) and PayPal. Payment is mandatory upon placing the order. The information transmitted during the payment process is protected by an online payment security system.

Products will be delivered to the shipping address
provided by the Buyer. Delivery times vary depending on product availability and on the shipping location.

The Buyer will be informed that their order has shipped via email and text message.

In accordance with the law, the buyer has the
right to exercise their rights to withdraw within 14 days of receiving the
products without a reason and without having to pay penalties. To exercise their right, the buyer must inform the seller by emailing the seller at: hello@kaloes.com. The seller will proceed with a refund within 5 days of receiving the returned products.

Legal Guarantee of Conformity

In accordance with the provisions of Articles L. 217-4 to L. 217-14 of the French Consumer Protection Act, all products sold by us are covered by the legal guarantee of conformity, which covers defects of conformity existing at the time of delivery of the product.

If a product sold suffers from defects of conformity, it can be returned and exchanged or reimbursed.

Products meeting the following criteria are considered as presenting a defect of conformity :

• A product that is not the model ordered
• A product that is not the color ordered
• A product that does not match the pictures
• A model that shows quality issues (subject to
  submission of photographic evidence and validation by Customer Service)

Legal Guarantee against Latent Defects

In accordance with the provisions of articles 1641-1649 of the French Civil Code, all the products we sell are covered by the legal guarantee against latent defects. If a product that was sold has a hidden defect making the product unfit for the use for which it was intended, or decreasing the use so much that the buyer would not have purchased the product or would have only purchased it as a lower price, the buyer can choose between having the sale canceled and getting a discount on the purchase price in accordance with article 1644 of the French Civil Code.

If we sold you a product that had a hidden defect at the time of purchase, we will replace or refund the product in compliance with the conditions provided by law.

We are
committed to providing premium quality service to our customers. However, due to the unpredictable nature of the Internet, we cannot guarantee that our services will meet all your expectations. Therefore, within the fullest extent permitted by law, we disclaim any all liability to you or any other party for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, business interruption, loss of data or damage to property, arising out of the use or inability to use our website.
However, we are committed to working with you in a diligent and professional manner to resolve any problems that you might encounter when using the kaloes.com website.

By purchasing
products from this website, you agree that our total liability to you, for
whatever reason, is limited to your purchase from this website. In no event shall we be liable for any indirect, special, incidental, or consequential loss or damage.

The parties agree to submit to the personal jurisdiction of these courts and waive any objection as to jurisdiction, venue, or form of action.

The sale
terms and conditions currently mentioned on the www.kaloes.com website apply to all sales until they are removed. However, KALOES reserves the right to modify those terms and conditions at any time. If changes are made to the terms and conditions, the new terms and conditions will only apply to orders placed after those terms and
conditions have been changed.
